Welcome to Tomira. These Terms of Service ("Terms") govern your access to and use of the Tomira mobile application ("App", "Service"). By accessing or using Tomira, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Tomira, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Tomira on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use Tomira. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the Service.

3. User Accounts

To access certain features of Tomira, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4. User Content

Your Content:

You retain ownership of all content you post on Tomira, including videos, comments, and profile information ("User Content"). By posting User Content, you grant Tomira a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display your content in connection with operating and providing the Service.

Content Standards:

You agree that your User Content will not:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Contain hate speech, harassment, or bullying
• Include explicit, violent, or inappropriate content
• Promote illegal activities or dangerous behavior
• Contain spam, malware, or deceptive content
• Impersonate others or misrepresent your identity

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service
• Collect or harvest user information without consent
• Reverse engineer or attempt to extract source code
• Remove or modify any copyright or proprietary notices

6. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are owned by Tomira and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Tomira name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Tomira. You may not use such marks without our prior written permission.

7. Content Moderation

We reserve the right, but are not obligated, to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We may take action including warning, suspending, or terminating accounts that violate these Terms.

8. In-App Purchases

Tomira may offer virtual items or premium features for purchase ("In-App Purchases"). All purchases are final and non-refundable except as required by law. Prices are subject to change without notice. Virtual items have no real-world value and cannot be exchanged for cash.

9. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Tomira. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TOMIRA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMIRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tomira and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through the app settings. Upon account deletion, your User Content may be removed from the Service, though some content may remain in backups for a limited time.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tomira operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for infringement of intellectual property rights.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
